05/24.03.2025 The grievance of the petitioner as raised in the present writ petition is that though Reference Case No. 1/2024 has been filed by him on 19.01.2024 invoking Section 2A of the Industrial Dispute Act, 1947 before the Central Government Industrial Tribunal-cum-Labour Court (No.1), Dhanbad, no effective step has been taken by the said Tribunal for adjudication of the same primarily due to the reason that the post of the Presiding Officer of the Tribunal is vacant since long.
2. Ms. Shiwani Jaluka, learned A.C to D.S.G.I appearing on behalf of the respondent Nos. 1 to 3, on instruction, submits that the charge of the Presiding Officer of the Central Government Industrial Tribunal No.1, Dhanbad has been given to the Presiding Officer of the Central Government Industrial Tribunal, Bhubaneswar and hence it cannot be said that the Central Government Industrial Tribunal No.1, Dhanbad is not functional. It is further submitted that the aforesaid reference case filed by the petitioner will be taken up by the Central Government Industrial Tribunal No.1, Dhanbad as per its age.
3. Considering the said submission of learned counsel for the respondent Nos. 1 to 3, the present writ petition is disposed of with a direction to the
Presiding Officer of the Central Government Industrial Tribunal No.1, Dhanbad to take up Reference Case No. 1/2024 according to its age and dispose it of in accordance with law without giving unnecessary adjournments to the parties.
