Neutral Citation No. - 2025:AHC:131138 Court No. - 7 Case :- WRIT - C No. - 20013 of 2025 Petitioner :- Haseen Ahmad And 3 Others Respondent :- State Of U.P. And 9 Others Counsel for Petitioner :- Amir Khan,Ayub Khan Counsel for Respondent :- C.S.C. Hon'ble Piyush Agrawal,J. At the very outset, learned Standing Counsel raises a preliminary objection with regard to maintainability of the writ petition on the ground that only a recovery order is under challenge and writ of mandamus has been sought for not auctioning the property in question. He further submits that auction takes place only in pursuance of some order, which is not under challenged. Confronted with the said fact, learned counsel for the petitioners prays for withdrawal of the writ petition at this stage. In view of the above, the writ petition is dismissed as withdrawn at this stage. However, it is clarified that dismissal of the writ petition will not preclude the petitioners from taking any other legal recourse as available to them under the law.
