JUSTICE RAJESH RAI K - 3 - HC-KAR NC: 2025:KHC:44987 WP No. 27571 of 2019 ORAL ORDER The petitioner is before this Court seeking direction by issuance of writ of mandamus to direct respondents No.1 to 4 to consider the representations at Annexures-A and B. 2. The grievance of the petitioner is that the petitioner was the absolute owner in possession and enjoyment of the land bearing Sy.No.65, measuring 0.25 guntas, situated at Karibeerana Hosahalli Village, Jadigenahalli Hobli, Hosakote Taluk, Bangalore Rural District. The said land was acquired by respondent No.5 - the Special Land Acquisition Officer and Competent Authority by Notification No. L.A.Q. / E.X.P.B.C. / S.R./ H.S.K. 4(16) 2016-17 dated 15.05.2017 as per annexure-E. Subsequently, the said Authority has passed the award and deposited award amount. However, respondent No.6 filed an objection before the Authority for not to release the award amount in favour of the petitioner. Hence respondent No.5 did not release the award amount in favour of petitioner. 3. Learned counsel for respondents No. 6 and 7 jointly submit that they have no claim whatsoever in respect of award amount passed by respondent No.5 in connection to land bearing - 4 - HC-KAR NC: 2025:KHC:44987 WP No. 27571 of 2019 Sy.No.65, measuring 0.25 guntas, situated at Karibeerana Hosahalli Village, Jadigenahalli Hobli, Hosakote Taluk, Bangalore Rural District, and the same can be disbursed in favour of petitioner in view of the settlement arrived in W.A.No.3146/2019 between themselves and the other parties. 4. In that view of the matter, Writ Petition is allowed, Respondent No.5 is directed to disburse the award amount in favour the of the petitioner in respect of land bearing Sy.No.65, measuring 0.25 guntas, situated at Karibeerana Hosahalli Village, Jadigenahalli Hobli, Hosakote Taluk, Bangalore Rural District in accordance with Law.
