HC-KAR NC: 2025:KHC:33326 WP No. 18392 of 2025
THIS WP IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA PRAYING TO a) ISSUE A WRIT OF MANDAMUS OR ANY OTHER APPROPRIATE WRIT, ORDER OR DIRECTION DIRECTING THE RESPONDENT AUTHORITIES TO CONSIDER REPRESENTATION DATED 30.04.2022 AT ANNEXURE-F; b) ISSUE A WRIT OF MANDAMUS DIRECTING THE RESPONDENT TO CHANGE THE KHATA/ RTC IN THE NAME OF PETITIONER, IN ACCORDANCE WITH LAW AND c) PASS SUCH OTHER ORDER OR DIRECTION AS THIS HON’BLE COURT MAY DEEM FIT IN THE INTEREST OF JUSTICE AND EQUITY.
THIS PETITION COMING ON FOR ORDERS THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE R DEVDAS
ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents.
2. The petitioner is seeking a writ of mandamus directing the respondent No.2 - Assistant Commissioner, Hoskote Sub-Division, Bengaluru Rural District to consider the representation dated 30.04.2022 at Annexure - F given by the petitioner for entering the name of the petitioner in the revenue records pertaining to 1 acre 18 guntas in Sy.No.51 (Old Sy.No.7) situated at Banarahalli Village, Anugundahalli Hobli, Hosakote Taluk.

HC-KAR NC: 2025:KHC:33326 WP No. 18392 of 2025
3. The basis of the claim for the petitioner is a compromise decree passed by the learned I Additional Senior Civil Judge, Bengaluru Rural District in O.S.No.413/1994. It is contended that in terms of the compromise petition filed by the parties, item No.11 i.e., suit schedule property measuring 2 acres is allotted in favour of the petitioner.
4. However, this Court finds that the representation is given to the Assistant Commissioner and not to the Tahsildar. Secondly, only 1 acre 18 guntas is claimed by the petitioner, although 2 acres have fallen to the share of the petitioner in terms of the compromise decree.
5. In that view of the matter, the writ petition stands
disposed of reserving liberty to the petitioner to give a fresh representation to the Tahsildar concerned enclosing copy of the compromise decree for necessary orders. If such application is filed by the petitioner, the Tahsildar shall act upon the same in terms of the compromise petition, after issuing notice to all concerned.
