Mr. Ashish Gupta, Advocate for respondent No.1. **** Learned counsel for the appellant has submitted that the present appeal has been filed by the driver and has submitted that on 30.06.2010, the execution was stayed only against the present appellant i.e., driver and that there was no stay in favour of the owner of the vehicle and it was always open to respondent No.1-claimant to have recovered the amount from the owner. Learned counsel for the appellant, in view of the submissions made on 09.09.2025 and also the fact that there was no stay in favour of the owner of the vehicle, has submitted that the present appeal be disposed of but liberty be granted to the appellant to revive the case in case respondent No.1-claimant claims any amount against the present appellant or files any execution application against the present appellant. 4.
