JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 2 22-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in connection with Andharathadi P.S. Case No. 22 of 2023, instituted under Sections 272, 273 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act. 3. As per the prosecution case, there is recovery of 22 litre illicit liquor from different places out of which 2 litre has been recovered from the back of the house of the petitioner. 4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. Recovery of illicit liquor has been made from an open place which is accessible to all. Petitioner has no concern with the seized liquor. There is no Patna High Court CR. MISC. No.58507 of 2025(2) dt.22-09-2025 2/2 independent witness to the seizure-list. Petitioner has no criminal antecedent. He undertakes to co-operate in the investigation and trial. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner. 6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the Petitioner, above-named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Special Judge Excise Act, Jhanjharpur in connection with Andharathadi P.S. Case No. 22 of 2023, subject to the conditions laid down in Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023. rakhi/- (Sunil Dutta Mishra, J.) U T
