Counsel for Applicant :- Nirbhay Singh Counsel for Opposite Party :- G.A. Hon'ble Ashutosh Srivastava,J.
1. Heard Sri Nirbhay Singh, learned counsel for the applicant and Sri Ajay Singh, learned AGA for the State-Respondent. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 544 of 2024, under Sections 103(1), 191(2), 191(3), 190, 3(5) of BNS, and Section 3/25 of Arms Act, Police Station Swar, District Rampur, during pendency of the trial in the court below. 3. FIR of the present case was lodged on 03.12.2024 against three named persons and according to the FIR on 03.12.2024 at about 7 P.M. in the night, the named persons committed the murder of the nephew of the informant. 4. Learned counsel for the applicant submitted that the applicant is not named in the FIR and during the course of investigation the name of the applicant was surfaced in the confessional statement of co-accused. The applicant has been implicated in the present case on the basis of false allegations, and admittedly, the informant was not an eye witness. 5. He further submitted that however, during investigation witnesses Aqueel Ahmad and Zameer Ahmad tried to state that they were eye witnesses but they also did not state that the applicant committed the murder of the deceased. 6. He further submitted that both the alleged eye witnesses categorically stated that co-accused Abrar, Imran, Gufran and Asim committed the murder of the deceased and from their statements it reflects that that applicant also conspired for the alleged crime. 7. He further submitted that except the bald and verbal allegation of conspiracy, there is no cogent evidence of conspiracy against the applicant. 8. It is further submitted that on the similar footing the co-accused Mohd. Ahmad @ Mulla and Gufran have been granted bail by the Court vide order dated 18.03.2025 and 24.06.2025 passed in Criminal Misc. Bail Application No. 8963 of 2025 and 18207 of 2025, therefore, the applicant is also entitled to be released on bail. 9.
He further submitted that however, apart from the present case, applicant is having criminal history of 2 other cases and both the criminal history have been explained in the affidavit filed in support to the instant bail application. 10. He further submitted that in the present matter, applicant is in jail since 03.02.2025. 11. Per contra, learned AGA however, opposed the prayer for bail but could not dispute the arguments on facts advanced by learned counsel for the applicant. 12. I have heard learned counsel for the parties and perused the record of the case. 13. From the record, it reflects that however, witnesses Aqueel Ahmad and Zameer Ahmad claimed themselves to be the eye witnesses but they did not state that applicant committed the murder of the deceased. As per their statements recorded during investigation, co-accused Abrar, Imran, Gufran and Asim committed the murder of the deceased by causing fire arm injury to him. However, according to them, applicant involved in the conspiracy but it reflects except the bald and verbal allegation of conspiracy, there is no cogent evidence in this regard against the applicant on record. 14. Further, however, apart from the present case, applicant is having criminal history of 2 other cases and the same has been explained in the affidavit filed in support to the instant bail application. 15. Further, in the present case, applicant is in jail since
03.02.2025. 16. Therefore, considering the facts and circumstances of the case, discussed above, in my view, applicant is entitled to be released on
bail. 17. Accordingly, without expressing any opinion on the merits of the case, the instant bail application is allowed. 18.
