The only submission which has been made by the learned counsel for the petitioners in the instant petition is that he would feel satisfied in case a direction is issued to the Assistant Commissioner (Revenue), Srinagar, to take a final call on the basis of communication which has been addressed to him by the Tehsildar, Khanyar, Srinagar, dated 9th February, 2023 for seeking building permission of the petitioners, which till date has not been accorded due consideration. 2. Since an innocuous prayer has been made by the learned counsel for the petitioners, on the asking of the Court Mr. Bikramdeep Singh, learned Deputy Advocate General caused appearance on behalf of the respondents and is not averse to the disposal of the instant writ petition. However, he submits that a decision on the basis of communication dated 9th February would be taken in accordance with the law and as per rules occupying the field. 3. Heard learned counsel for the parties at length and perused the record. 4. With the consent of the learned counsel for the parties, that instant writ petition is taken up for final disposal without issuing formal notice at this threshold stage, by directing the Assistant Commissioner (Revenue), Srinagar, to take a decision in pursuant to communication addressed by the Tehsildar Khanyar, Srinagar to his office way back on 9th February, 2023, strictly in conformity with the rules and as per law, within a period of four weeks from the date a copy of this order along with copy of writ petition along with its annexures, is made available to him. The decision which is likely to be taken by the Assistant Commissioner (Revenue), Srinagar be forwarded to the petitioners through registered posted. 5. Writ petition disposed of along with connected CM in the manner indicated above.
