1. The applicant through instant application under Section 11(6) of the Arbitration and Conciliation Act, 1996 (for short
“1996 Act”) is seeking appointment of an Arbitrator to adjudicate the dispute between the parties.
2. Mr. Naveen Batra, Advocate has put in appearance on behalf of the respondents and filed his power of attorney. The same is taken on record. Registry is directed to tag the same at an appropriate place.
3. Mr. Naveen Batra, Advocate submits that contract was executed outside the jurisdiction of this Court. The work was performed beyond the territorial jurisdiction of this Court. As per contract, the venue of arbitration would be at New Delhi or as determined by Arbitrator with the consent of both sides. 4. Mr. Lajpat Rai Sharma, Advocate for the applicant submits that applicant is resident of State of Haryana, thus, this Court has territorial jurisdiction to entertain the present application.
5. As no part of cause of action has arisen within the jurisdiction of this Court and as per arbitration agreement ‘venue’ of the arbitration would be at New Delhi or as determined by Arbitrator with the consent of both sides, this Court does not find it appropriate to invoke its jurisdiction under Section 11(6) of 1996 Act.
6. Dismissed with liberty to applicant to approach Court of competent jurisdiction.
