Heard Mr. Sanjay Kumar Pal, learned counsel for the applicants, Mr. Moses Dass, learned counsel for opposite party no.2 as well as learned AGA for the State and perused the record. The present application under Section 482 Cr.P.C. has been filed for quashing of the charge-sheet no.48 of 2020 dated 26.01.2020, cognizance/ summoning order dated 27.09.2022 as well as entire criminal proceeding of Case No.24938 of 2022 (State Vs. Abhishek John and others), under Section 376, 323, 504, 506, 120B I.P.C., Police Station Kankar Khera, District Meerut, pending in the court of Chief Judicial Magistrate, Meerut. Learned counsel for the applicants submits that applicant no.1 Abhishek John @ Sanni has solemnized marriage with opposite party no.2/ victim and all the disputes between the parties have been amicably resolved, therefore, entire proceedings of the aforesaid criminal case may be quashed by this Court. Learned counsel for opposite party no.2 has no objection to the submission made by counsel for the applicants and submits that he has no objection, if the proceedings of the aforesaid case may be quashed. Learned A.G.A. for the State also has no objection to the prayer made by counsel for the applicants. I have heard learned counsel for the parties and perused the records. It is apparent that after investigation police has submitted charge- sheet against the applicant in the aforesaid case crime number on which cognizance was taken, but during the pendency of the application, a compromise has been reached between the parties and all the dispute between them have been amicably resolved. Since applicant no.1 has solemnized marriage with opposite party no.2/ victim/ informant, no useful purpose shall be served by prolonging the proceedings of the above mentioned criminal case as the parties have already settled their dispute. Accordingly, the proceedings of charge-sheet no.48 of 2020 dated 26.01.2020, cognizance/ summoning order dated 27.09.2022 as well as entire criminal proceeding of Case No.24938 of 2022 (State Vs. Abhishek John and others), under Section 376, 323, 504, 506, 120B I.P.C., Police Station Kankar Khera, District Meerut, pending in the court of Chief Judicial Magistrate, Meerut, are hereby quashed. The application is, accordingly, allowed. There shall be no order as to costs.
