ORAL ORDER
1. This petition is filed challenging Notice dated 24.07.2025 issued under section 264 of the Gujarat Provincial Municipal Corporations Act, 1949, by Surat Municipal Corporation, whereby the person referred in the Notice, has been directed to restructure the building, after taking audit of the same and to produce Structure Stability Report before the authority concerned. Notice states that the building in question is in dilapidated condition and urgent repairs of the said building is necessary, for which, immediate actions are required by the owner/ occupier of the building in question.
2. Heard learned advocate Mr.Zamir Shaikh for the petitioner and learned advocate Mr.Manan Maheta for the respondents.

Learned advocate Mr.Zamir Shaikh for the petitioner submitted that though Notice dated 24.07.2025 is not issued to the petitioner, he being interested party, the petitioner may be permitted to repair the building in question. The petitioner is also ready to get Structure Stability Report, upon repairs and to be produced before the authority, as referred in the Notice dated 24.07.2025. This Court could not see any merit in the petition since Notice under challenge dated 24.07.2025 is issued to some other person and not to the petitioner. In the opinion of this Court no cause of action has arisen against the petitioner and therefore, this petition is rejected.
