The instant second petition has been filed under Section 483 of BNSS, 2023 for grant of interim regular bail for 10 days to the petitioner in case FIR No.145 dated 18.07.2023 under Sections 302/148/149/120-B of IPC, 1860, registered at Police Station Sadar, Ludhiana (Annexure P-1) on the ground of marriage of the petitioner, fixed for 09.06.2025 and 10.06.2025. It has been submitted by learned counsel for the petitioner that the petitioner is being prosecuted in the above mentioned FIR and presently he is lodged in District Jail, Ludhiana. He submits that the petitioner has entered into relationship with a girl and thus, he wants to perform marriage. He further submits that for performing the marriage, petitioner be granted the interim bail. State was directed to file the status report and the same has been filed. Learned State counsel has opposed the submissions made by the counsel for the petitioner. CRM-M-31832-2025 2 declined the prayer of the petitioner vide order dated 29.05.2025 passed in CRM-M-29823-2025 titled as “Suhail Ali Vs. State of Punjab”. He submits that the petitioner is involved in a case of murder, which is heinous offence. However, the factum regarding the marriage of the petitioner has been verified. He further submits that name of the parents of the bride Diksha @ Saira, has been mentioned as Begam Indrawati & Janab Surinder Kumar, just to mislead the Court. Statements of father of the petitioner and the girl are placed on record as Annexure R-2/T and R-3/T. On hearing, learned counsel for the parties and perusal of the record, it is deciphered that prayer of the petitioner on the same ground had earlier been declined. The petitioner is facing prosecution in FIR No.145 dated 18.07.2023 under Sections 302/148/149/120-B of IPC, 1860, registered at Police Station Sadar, Ludhiana (Annexure P-1), which is heinous offence.
On weighing the facts and circumstances of the present case, this Court does not find it appropriate to release the petitioner on interim bail and the same is hereby stands dismissed. (RAJESH BHARDWAJ) 02.07.2025
