Mr.R.Gururaj, learned counsel for the 1st respondent submitted that the petitioner has already filed an application for rejection of the plaint under Order 7 Rule 11 of Civil Procedure Code, and the same is pending before the trial Court in I.A.No.4 of 2019. The learned counsel for the revision petitioners fairly admits the said position. 3. In view of the above fact, it would be appropriate for the petitioners to pursue the said application before the trial Court viz., the application seeking rejection of the plaint. It would not be in the interest of the parties to seek a parallel decision to strike of the plaint. In the light of the admitted position that the petitioner has already move an application for rejection of plaint and the same is pending before the trial Court, this Court issues a direction to the trial Court to dispose of the https://www.mhc.tn.gov.in/judis 6 application in I.A.No.4 of 2019 within a period of six weeks from the date of receipt of a copy of this order. The trial Court shall decide the application under Order 7 Rule 11 of Civil Procedure Code. 4. With the above direction, the civil revision petition is disposed of. No costs. It is stated that notice to the respondents 2 to 36 are given up by order dated 19.09.2023, which has not been reflected in the appearance column. Registry is directed to insert “ Respondents 2 to 36 are given up” in the appearance column of the order dated 18.07.2025”. 3. Paragraph 3 of the order shall stand deleted and substituted as follows: “ In view of the above fact, it would be appropriate for the petitioners to pursue the said application before the trial Court viz., the application seeking rejection of the plaint.
