JUDGMENT AND ORDER (ORAL)
1. The petitioners, presently working as Havildar (ORL), are before this Court praying for first financial upgradation under the relevant ACP Scheme. Their prayer is based on the ground that the respondents while 2025:MLHC:478

upgrading or redesignating the petitioners to the post of Havildar (ORL) had treated it as a promotion which had resulted in the denial of the petitioners’ benefits of the first financial upgradation under the ACP Scheme.
2. Mr. M.Chanda, learned counsel for the petitioners has submitted that the petitioners are similarly placed as the petitioners in WP(C). No. 418 of 2024, whereby this Court vide judgment and order dated 17-02-2025, had
directed the respondents to extend the benefits of the first financial upgradation under the ACP Scheme. He therefore, submits that as this case is covered by the aforementioned judgment, the same benefit be allowed to the petitioners herein.
3. Dr. N.Mozika, learned DSGI does not dispute the existence of the orders in similarly situated matters, but has only objected to the time taken by the petitioners to approach the Court for redressal of their grievances.
4. Having heard learned counsel for the parties and on consideration of the facts and materials, especially the earlier orders passed in similar matters, wherein this Court had come to the finding that remusteration is not a promotion or a financial upgradation, and that counting of service for financial upgradation under the ACP Scheme should be from the date of remusteration or date of initial entry to service, the instant case inspite of delay, is covered by the earlier judgments of this Court. 2025:MLHC:478

5. As nothing remains for consideration, the writ petition is closed and
disposed of in the light of the earlier judgments rendered by this Court.
6. The respondents are also expected to complete the entire necessary exercise within a period of 6(six) months from the date of receipt of this
order by the respondents.
