Mr. Avidit Noliyal learned counsel for the applicant. 2. Mr. V.S. Pal, learned Assistant Government Advocate for the State. 3. Present applicant ‘Kirti Singh’ is praying for regular bail in relation to First Information Report dated 17.04.2025 bearing FIR No. 0171 of 2025, Police Station – Kotwali Jwalapur, District – Haridwar wherein present applicant along with one Bhagwandas were implicated for the offence punishable under Section 8 / 20 of the NDPS Act. 4. Learned counsel for the applicant submits that present applicant is innocent and has been falsely implicated and the alleged contraband Charas, which is shown to be recovered from the present applicant, is 502 gram Charas, which is much below commercial quantity and the present applicant has no previous criminal history. 5. On the other side, learned State Counsel have not disputed this fact that alleged contraband charas, which is shown to be recovered from the present applicant is much below commercial quantity and present applicant has no previous criminal history. 6. After hearing the arguments of learned counsel for the parties and further taking into consideration that alleged contraband charas, which is shown to be recovered from the present applicant is much below commercial quantity and in view of the statement made in paragraph 5 of the bail application the present applicant has no previous criminal history, therefore, this Court is of the view that 2025:UHC:4159 applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant ‘‘Kirti Singh” be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
