ORAL ORDER Leave to amend is granted. Necessary amendment to be carried out forthwith.
1. The present application is filed by the Applicant for enlarging him on Parole leave for a period of 2 days on the ground of registration of the sale deed.
2. Heard learned Advocate Mr. Jaspalsinh Jadeja for the Applicant and learned APP Ms. Krina Calla appearing on behalf of the Respondent – State.
3. Rule returnable forthwith. Learned APP waives service of Rule on behalf of the Respondent State.
4. Learned advocate Mr. Jadeja submits that, applicant may be granted parole, for the purpose of registration of sale deed. Learned
R/SCR.A/15945/2025 ORDER DATED: 05/12/2025 advocate Mr. Jadeja has also submitted the proposed copy of the sale deed as well as the copy of registration appointment schedule. Hence he may be released on 02 days of Parole Leave.
5. Having heard the arguments advanced by the learned Advocate for the Applicant and the ground mentioned in the Application, this court is inclined to exercise discretion in favour of the applicant.
6. The application is partly allowed. The Applicant – SHAILESH VIJAYSINH KAMALIYA is ordered to be released on Parole Leave and he has to be taken to Sub-registrar’s Office at Paddhari, District Rajkot on 09.12.2025 from 10:00am to 5:00pm. The time of traveling to and fro shall be excluded. The police personnel shall accompany in civil clothes. The lost of police custody shall be borne by the State.
7. The application is partly allowed in the aforesaid terms. Rule is made absolute. Direct service Today is permitted.
