learned counsel for the petitioner, learned Additional Government Advocate for respondent No.1 and
learned counsel for respondent No.2.
2. It is submitted by learned counsel for respondent No.2 that, respondent No.2 is now aged 60 years 5 months and she is not entitled for reinstatement as ordered by respondent No.1.
3. Respondent No.1 by order dated 21.08.2008 allowed the dispute and directed respondent No.2 to be reinstated with immediate effect. However, it is specifically stated that, respondent No.2 is not entitled for payment of consequential monetary and service benefits including back wages or costs. The said order of respondent No.1 is confirmed

by the Karnataka Appellate Tribunal, Bengaluru vide order dated 21.07.2017, by dismissing the appeal. Being aggrieved by the same, the petitioner is before this Court.
4. In view of the fact that respondent No.2 has already attained the age of superannuation by attaining the age of 60 years, she is not entitled to be reinstated as directed under the impugned order. Under such circumstances, the writ petition does not survive for consideration.
Accordingly, the petition is dismissed.
