During the course of hearing learned counsel for the applicant has corrected the prayer clause of this application. Sri Harish Chandra Mishra, learned counsel for the applicant and Sri Alok Mishra, learned A.G.A. for the State are present. The present application u/s 528 of BNSS of 2023 has been filed with prayer to modify the order dated 09.08.2024 passed by Additional Chief Judicial Magistrate, Court No. 1, Jhansi in Complaint Case No. 12909 of 2022 (Panna Lal vs. Harikishun and others), P.S. Mauranipur, District Jhansi, whereby learned Magistrate has not taken cognizance under Sections 306, 406, 511, 328, 210, 34, 120B, 201 IPC. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicant after retaining a photocopy of the same.
