Heard Sri Ajay Nand Pandey, learned counsel for the applicant, Sri Ravi Shankar Tripathi, learned counsel for opposite party no. 2 and learned A.G.A. for the State. 2. The present application under Section 528 BNSS, has been filed for quashing the charge sheet no. 289 of 2020 dated 11.10.2020, summoning/cognizance order dated 6.8.2021 under sections 420, 406, 506 IPC as well as NBW and notice of 82 and 83 Cr.P.C. dated 2.4.2025 and proceedings of Criminal Case no. 9320 of 2021 (State vs. Ravindra Nath and others) arising out of Case Crime no. 341 of 2019 under sections 420, 311, 406, 506 IPC, PS- Ujhani, District Budaun. 3. Learned counsel for applicant submits that impugned order is against the facts and law. The applicant had no knowledge about the proceedings initiated against him due to which he could not appear on the date fixed by the trial Court, hence, non-bailable warrant was issued against the applicant. 4. Per contra, learned A.G.A opposed the prayer. 5. Considering the facts and circumstances of the matter, applicant is directed to appear before the learned court concerned in pursuance to impugned NBW order issued against applicant which culminated into proceeding under Section 82 and 83 Cr.P.C. within four weeks from today. Till four weeks from today, no coercive action shall be initiated against the applicant. After the expiry of aforesaid period of four weeks, learned Versus Counsel for Applicant(s) : Ajay Nand Pandey Counsel for Opposite Party(s) : G.A., Ravi Shankar Tripathi Virendra Paswan .....Applicant(s) State of U.P. and Another .....Opposite Party(s) concerned court is directed to proceed as per law. However, it is made clear that none of the grounds are convincing for seeking quashing of orders impugned along with entire proceeding. 6.
