Neutral Citation No. - 2025:AHC:6387 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 302 of 2025 Petitioner :- Lachcho And 5 Others Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Babboo Ram,Shivarchan Mishra Counsel for Respondent :- C.S.C. Hon'ble Rohit Ranjan Agarwal,J. This is a plaintiffs' petition. In suit instituted by the plaintiffs, a temporary injunction was granted which was disobeyed by the defendants-respondents authorities. Thereafter, petitioners had filed an application under Order 39 Rule 2A CPC which was dismissed for want of prosecution. Thereafter, a restoration application No.372 of 2024 has been filed by the petitioners which is pending consideration. The sole prayer made in the writ petition is for early disposal of the restoration application. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon Civil Judge (Senior Division)/F.T.C., Mathura to decide the Restoration Application No.372 of 2024, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law, expeditiously, preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
