ORAL ORDER Petitioner is seeking to quash the charge sheet and the order passed by the learned Magistrate, taking cognizance of the offence Punishable under Section 506, 341 and 323 of IPC.
2. As could be seen from the material on record including the charge sheet allegations that the petitioner is the son of respondent No.2 / defacto complainant. It is alleged he used to pick up quarrel for petty reasons. He had registered the property of his father in his name and after the demise of his father, quarrelling with his

mother for every petty reason. On 17.06.2022 at about 11:00 p.m., he is alleged to have picked up quarrel with his mother, held her neck, assaulted and threatened her with dire consequences, if she did not leave the house.
3. Charge sheet is filed based on the statements of the complainant and the eye witnesses, CWs.4 and 5. The complaint averments disclose prima-facie case against the petitioner, though it is contended that the complaint is motivated and there is no mention of statements of eye witnesses. The contention raised is a matter for trial and this Court cannot conduct a mini trial in this petition filed under Section 482 of Cr.P.C. Moreover, it is submitted by the learned High Court Government Pleader that the charges are already framed in this case and the complainant has been examined as P.W.1. The order framing of charges is not challenged by the petitioner. There are no grounds made out to quash the proceedings. Petition is dismissed.
I.A.No.1/2025 is disposed of.

The dismissal of the petition and the observations made in the order shall not influence the learned trial Judge while disposing the matter.
