Present petition under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed for grant of regular bail to the petitioner in case FIR No.0013 dated 26.02.2025, under Section 111 of BNS and Section 25(6), 25(7) and 28 of Arms Act 54 of 1959, registered at Police Station Harike, District Tarn Taran. 2. Status report dated 15.09.2025 by way of affidavit of Lovkesh, PPS, Deputy Superintendent of Police, Sub-Division Patti, District Tarn Taran has been filed on behalf of respondent-State and the same is taken on record. 3. Brief facts of the prosecution case are that on 26.02.2025, ASI Sukhwant Singh along with other police officials was on patrolling duty, when he received a secret information to the effect that Jobanpreet Singh @ Joban and Jaspreet Singh @ Jassa possess imported weapons and they have formed a gang, led by one Baltej Singh and they indulge in illegal activities and supply illegal arms and many FIRs have been registered against them. The said information was found to be reliable and formal FIR under Section 111 of BNS, 25(6), 25(7), 28 of the Arms Act was registered and the police party reached at the disclosed place from where both were apprehended. On interrogation, Jobanpreet Singh @ Joban & Jaspreet Singh @ Jassa suffered a disclosure statement to the effect that he has kept concealed Glock 9 MM Pistol along with 02 Magazines and 05 live cartridges under the garbage on the road side on highway and they can get the same recovered. They further disclosed that he had purchased the pistol from Mohpreet singh @ Moh and thereafter, both the accused got recovered the pistol from the disclosed place. 4. Upon notice, the State counsel has appeared and has opposed the bail. Both the parties have been heard and material placed on the file has been perused. 5. Learned counsel for the petitioner argued that petitioner has been falsely implicated in the present case. Petitioner is in custody since 26.02.2025. There is no evidence that petitioner has formed a gang with any of the co-accused or is indulging in organized crime. Learned counsel for the petitioner further argued that the pistol in question was got recovered by co-accused Jobanpreet Singh @ Joban and it is highly improbable that they will conceal a pistol make Glock on the road side under the garbage. Learned counsel next contended that final report has already been presented after completion of investigation and the trial is likely to take a long time to conclude and further detention of the petitioner is not required and he may be released on bail. 6. On the other hand, learned State Counsel has opposed the bail and argued that petitioner along with co-accused is indulging in organized crime and AMANDEEP GOSAIN 2025.09.16 18:39 I attest to the accuracy and integrity of this order/judgment CRM-M-35379-2025 - 3- they supply illegal weapons to notorious criminals in the area and in view of the gravity of the offence, petitioner does not deserve the concession of bail. 7. There is no material, at this stage, to come to the conclusion that petitioner along with other co-accused has formed any gang or he was indulging in any organized crime. The petitioner along with co-accused has been arrested on the basis of secret information and one pistol has been recovered at their instance, which was allegedly concealed on the road side. Petitioner is in custody since 26.02.2025. Final report has already been presented after completion of investigation. The trial is likely to take a long time to conclude and further detention of the petitioner is thus not required and he deserves to be released on bail. 8. Having regard to the aforesaid factual position, but without commenting anything upon the merits of the case, the present petition is allowed and petitioner is ordered to be released on bail on furnishing bail bonds and surety bonds to the satisfaction of learned Trial Court concerned, on usual terms and conditions.
