Mr. Bharat Chaudhary, learned counsel for the Applicant. 2. Mr. Girish Chandra Joshi, learned AGA assisted by Mr. Rakesh Negi, learned Brief Holder for the State. 3. Present bail application has been moved on behalf of the Applicant. The Applicant is in judicial custody in connection with Case Crime No.40 of 2024 for the offence punishable under Section 27-A & 29 of The Narcotic Drugs and Psychotropic Substances Act, 1985 (for short the N.D.P.S. Act) registered at Police Station Purola, District Uttarkashi. 4. Heard Mr. Bharat Chaudhary, learned counsel for the Applicant and Mr. Girish Chandra Joshi, learned AGA for the State of Uttarakhand. 5. As per the story narrated in the FIR on 28.11.2024 three persons were allegedly found in possession of 2 killogram and 16 gram charas while driving a Bolero vehicle bearing registration no.UK07TB 3305 near Mori Road, District Uttarkashi. A police team intercepted the vehicle and allegedly recovered contraband from a bag inside the vehicle and all the three persons were arrested on the spot. 2025:UHC:5870 6. Learned counsel for the Applicant submits that the Applicant has been falsely implicated on the basis of suspicion. Learned counsel for the Applicant submits that accused persons who have been arrested by the police at the spot have already been granted bail by this Court vide orders dated 28.03.2025, 08.05.2025 and 08.05.2025 and on the basis of parity present Applicant is also entitled for bail. 7. Learned State counsel has not opposed the bail application. 8. After hearing the learned counsel for the parties, on perusal of the record and without going into the merits of the case, this Court is of the opinion that the Applicant is entitled to be released on bail. 9. Accordingly, the bail application is allowed. Let the Applicant- Shahzad be released on bail on his furnishing a personal bond and two sureties of the like amount to the satisfaction of court concerned.
