Apprehending his arrest, the petitioner, namely, Sri Amrit Das @ Patil, son of late Radha Das, resident of Village-Kaharpara, P.O.-Rani, Police Station-Palashbari, District- Page No.# 2/3 Kamrup, Assam has filed this application under Section 482 BNSS seeking pre-arrest bail in South Guwahati Range, Lokhra Police Station FIR/case No. Forest Offence No.SG/13 of 2024-25 registered under Section 24/25/34/35/40/41/49(1) of the Assam Forest Regulation 1891. 3. The Court by order dated 07.02.2025, while calling for the case diary, granted interim pre-arrest bail to the petitioner in said South Guwahati Range, Lokhra Police Station FIR/case No. Forest Offence No.SG/13 of 2024-25. 4. Mr. B. Sarma, learned Special Public Prosecutor, Forest Department place the case diary and from the same submitted that the petitioner after obtaining interim bail in said South Guwahati Range, Lokhra Police Station FIR/case No. Forest Offence No.SG/13 of 2024- 25 appeared before the concerned Investigating Officer of the case and his statement has been recorded and that he is co-operating with the investigation of the case. 5. Considering the materials in the case diary, the Court is of the view that custodial detention of the petitioner is not warranted for further investigation of said South Guwahati Range, Lokhra Police Station FIR/case No. Forest Offence No.SG/13 of 2024-25. Accordingly, this pre-arrest bail application of the petitioner is accepted. 6. Accordingly, the interim pre-arrest bail granted to the petitioner on 07.02.2025 in said South Guwahati Range, Lokhra Police Station FIR/case No. Forest Offence No.SG/13 of 2024-25, is hereby made absolute, subject to the compliance of the terms and conditions as specified in the order dated 07.02.2025 and on compliance of the following conditions that the petitioner – (i) shall appear before the concerned Investigating Officer of said South Guwahati Range, Lokhra Police Station FIR/case No. Forest Offence No.SG/13 of 2024-25 as and when he required for necessary investigation of said case; (ii) shall not leave the jurisdiction of the Range Forest Officer, Police Station, South Guwahati Range, Lokhra without obtaining prior written permission from the concerned Investigating Officer of the Case and (iii) shall not indulge himself in any criminal activities in future. 7. Any violation of the aforesaid terms and conditions as well as the terms and conditions as specified in the order dated 07.02.2025, noted above, by the petitioner, named above, the pre-arrest bail granted to him in the aforementioned South Guwahati Range, Lokhra Page No.# 3/3 Police Station FIR/case No. Forest Offence No.SG/13 of 2024-25 shall stand automatically vacated. 8.
