I/ with Crime No.190 of 2024 of Obulavaripalli Police Station, Annamayya district. 2. A case has been registered against the petitioners herein and another for the offences punishable under Section 118(1) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3(1)(r)(s) and 3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act,
2015. 3. Case of the prosecution, in brief, is that, there was land dispute between the de facfo complainant and the accused.
While so, on 21.10.2024, Al to A4 entered into the disputed land and ploughed the same. when the de facfo complainant and others obstructed, Al to A4 are alleged to have grew Wild, abused them by touching their caste and beat them with a stick. The de facfo complainant received bleeding injury On his head and left elbow, one panta Narasimhulu received bleeding injury on his head and one Madagalam Prabhudas received blood injury on his right hand and rI-ght leg. 4. 5. A perusal of the material on record goes tO Show that there was a dispute between the accused and the de facfo complainant with regard to a land, as both of them are claiming the same. Learned Senior Counsel Sri Posani Venkateswarlu, representing sri petluri Nagaraju, learned counsel for the petitioners, Submits that an interim injunction was granted in favour of the petitioners herein on o5.01.2024 in lA No.9 of 2024 in OS No.2 of 2024 on the file of the learned Junior Civil Judge, Railway Kodur, restraining the de facfo complainant and his men from interfering with their peaceful possession and enjoyment of the property of the petitioners. In respect of the alleged incident said to have taken place on the date of offence, the petitioners herein are alleged to have caught hold of the de facfo complainant and that another person, who went along with the petitioners, is alleged to have beat the de facto complainant with a stick causing grievous injury to him. The said person is not shown as accused in the present crime. lnsofar as the petitioners herein are concerned+, I except stating that they caught hold of the de facfo complainant and others and abused them, pr,'ma fac,®e, no accusation has been made -against them that they are instrumental in causing grievous injury to the de facto complainant.
