Counter affidavit filed by learned A.G.A is taken on record. The writ petition has been filed praying for following reliefs :- "(i). Issue a writ order or direction in the nature of mandamus commanding the respondents authorities particularly the respondent no. 2 / Commissioner of Police (Police Commissioner), Prayagraj to assure life and liberty of petitioners as provide under Article 21 of Constitution of India. (ii). Issue a writ order or direction in the nature mandamus commanding the respondent authorities not to interfere in life and liberty of the petitioners except following due procedure of establish under law. (iii). Issue a writ order or direction in the nature mandamus commanding the respondent no. 2 / Commissioner of Police (Police Commissionerate), Prayagraj to institute inquiry in pursuance of application dated 02.06.2025 moved by the petitioner no. 2 and to conclude the same within stipulated period fixed by this Court." Counsel for the petitioners submits that after filing of this writ petition, petitioner no. 2, Alok Pandey, husband of petitioner no.1 has been released from police custody but an F.I.R has been lodged against him. The above reliefs prayed in the writ petition cannot be granted since petitioner no. 2 is already out of police custody. The writ petition is accordingly, dismissed as infructuous.
