Mr. Deep Prakash Bhatt, learned Counsel for the applicant. 2. Mr. Deepak Bisht, learned Deputy Advocate General, assisted by Mr. Devendra Kumar, learned AGA for the State. 3. Applicant- Surya Vikram Sha, who is in judicial custody in connection with Case Crime/FIR No. 16 of 2024, under Sections 8, 21, 22, 60 of N.D.P.S. Act, registered at Police Station Banbasa, District Champawat, has sought his release on bail. 4. Heard learned counsel for the parties and perused the material available on record. 5. Learned counsel for the applicant submits that inventory was prepared on 03.02.2024, in which, FIR No. 16 of 2024 was mentioned, whereas the FIR was registered on 04.02.2024 i.e. the next day; the alleged contraband,170 pieces of BUPERNORPHINE INJECTION IP REXOGESIC 2 ML and 3.35 Gram Smack was recovered from the possession of the applicant on 03.02.2024, for the same was the FIR was lodged on the next date i.e. 04.02.2024; only sample of smack was sent to Forensic Science Laboratory and no injunction was sent; the applicant belongs to a respectable family; he has no previous criminal history and has falsely been implicated in this case; learned counsel for the applicant further submitted that many mandatory provisions of the NDPS Act have been 2025:UHC:3041 observed by breach. He further submits that the applicant is ready to furnish reliable sureties to the satisfaction of Special Judge concerned, if he is granted bail. 6. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that the applicant deserves bail at this stage. 7. Accordingly the bail application is allowed. 8. Let the applicant be released on bail, on his executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
