Petitioner Vs. 1. The Chairman, Chennai Port Trust, Chennai. 2. The Traffic Manager, Chennai Port Trust, Chennai – 600 001. ... Respondents Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the second respondent's notification No.A2/0711/2024/T dated 26.05.2025 and quash the same and further direct the respondents to appoint the already selected 1/4 https://www.mhc.tn.gov.in/judis W.P.No.22014 of 2025 and wait listed candidates as per the notification No.A2/413/2018/T dated 31.07.2023. For Petitioner : Mr.S.Gopinathan For Respondents : No appearance ***** O R D E R The instant writ petition has been filed challenging the order dated 26.05.2025 passed by the second respondent. 2. The learned counsel for the petitioner would submit that though the second respondent had recruited candidates, vide notification dated 16.02.2023, still there are wait list candidates who are yet to be considered for appointment. But without appointing the wait list candidates, the second respondent issued another impugned notification in contravention to law and prodecure. According to the learned counsel for the petitioner, the wait list candidates of the previous notification had to be given appointment first before going for fresh recruitment. Therefore, contended that unless the wait listed candidates are given appointments, the second respondent cannot have any fresh recruitment. 2/4 https://www.mhc.tn.gov.in/judis W.P.No.22014 of 2025 3. Though the submission of the learned counsel for the petitioner appears to be attractive, it is a well-settled principle of law that whenever a fresh notification is issued, the wait list automatically get lapsed. Apart from that, keeping a wait list for more than three years would also be an anathema to the appointment proceedings. Hence, this Court does not find any merit in the present writ petition. 4. Accordingly, this Writ Petition is disposed of. Consequently, the connected Miscellaneous Petitions are closed.
