The learned Government Advocate appearing on behalf of the 2nd respondent submitted that an FIR has been registered in Crime No.261 of 2021 for offence under Section 294(b), 323, 506(i) of IPC and that the investigation is pending till date. The learned Government Advocate further submitted that the petitioner has been added as A1 in the FIR. 4. In the considered view of this Court, the mere registration of an FIR cannot be a ground to reject the issuance of passport to the petitioner.
The criminal case at the stage of an FIR is not a “case pending” and therefore, there shall be a direction to the 3rd respondent to act upon the application submitted by the petitioner and issue the passport to the petitioner, if the petitioner has satisfied all the other requirements, within a period of four weeks from the date of receipt of a copy of this order. 5.
