Neutral Citation No. - 2025:AHC:109413 Court No. - 65 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 23719 of 2025 Applicant :- Vinay Kumar Opposite Party :- State of U.P. and Another Counsel for Applicant :- Lavalesh,Rajesh Kumar Verma Counsel for Opposite Party :- G.A. Hon'ble Krishan Pahal,J. 1. List has been revised. 2. Heard Sri Rajesh Kumar Verma, learned counsel for applicant, Sri Arvind Singh Sengar, learned counsel for the informant, Sri Sunil Kumar, learned A.G.A. for the State and perused the material placed on record. 3. The present bail application has been filed by the applicant in Case Crime No.24 of 2024, under Sections 364-A, 302, 201, 120B, 34 I.P.C. and Section 3(2)(5) SC/ST Act, Police Station Raipura, District Chitrakoot with the prayer to enlarge him on bail. 4. This is the second bail application on behalf of the applicant. The first one was rejected by this Court vide order dated 22.10.2024 passed in Criminal Misc. Bail Application No.29822 of 2024. 5. Learned counsel for the applicant has stated that as a new ground, seven witnesses have been examined and the trial is at its conclusive end and there is no likelihood of applicant tampering with evidence and the applicant is not a flight risk. 6. Learned counsel for the applicant has further stated that there is nothing on record to suggest that the applicant has used mobile no.9455836625, as such, the applicant is entitled for bail. The applicant is in jail since 13.02.2024 and he is ready to cooperate with trial. In case, the applicant is released on bail, he will not misuse the liberty of bail. 7. Learned counsel for the informant and learned A.G.A. have vehemently opposed the bail application on the ground that the trial is almost at its logical end. 8. After hearing learned counsel for the parties and taking into consideration the facts that no new ground is there for pressing the second bail application and the trial is at its conclusive end, I do not find it a fit case for grant of bail to the applicant. 9. The bail application is found devoid of merits and is, accordingly, rejected. 10. It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
