Claimants of the case have filed the present appeal seeking enchancement of compensa!on, by assailing the Award dated 12.12.2022 of learned Motor Accident Claims Tribunal, Rewari. Along with appeal, an applica!on bearing No.11718-CII-2025 has been moved under Sec!on 5 of the Limita!on Act, to condone the delay of 809 days in filing the appeal.
2. The only ground pleaded by learned counsel to condone the delay is that the appellants were suffering from several diseases and under the shock of death of father of the appellants. It is also pleaded that they belong to down strata of the society and were not aware about the limita!on period.
3. The grounds pleaded by the appellants for long delay of 809 days in filing the appeal, are absolutely not jus!fiable as father of appellant had expired on 18.11.2018 and therea3er claim pe!!on was pursued by the appellants giving rise to present appeal. This Court is not convinced with the reasons given in the applica!on, to condone the delay. Finding no jus!fiable ground for condona!on of delay, the applica!on is hereby dismissed.
