Learned Advocate for the petitioner submits that despite depositing the quotation amount, WBSEDCL has failed to provide electricity connection to his submersible pump sets. Learned Advocate appearing for WBSEDCL submits that for effecting such connection, certain electricity poles are required to be installed. However, due to objections raised by the neighbouring landowners, the poles could not be erected. Learned Advocate further submits that if the petitioner produces way-leave permission from the adjoining owners, the poles can be erected and, accordingly, the electricity connection can be provided. 2 I am of the view that in the present proceeding, there is no scope to adjudicate the said dispute. I, therefore, direct WBSEDCL to refer the matter to the District Magistrate, Murshidabad, under Rule 3(b) of the Works of Licensees Rules, 2006. Upon such reference being made, the District Magistrate, Murshidabad, shall decide the dispute after giving due notice to all concerned parties. Accordingly, WPA 23111 of 2025 is disposed of.
