The petitioner has filed this application for quashing of order dated 03.09.2022, passed by the learned A.C.J.M., Ghatshila in connection with Ghatshila P.S. Case No. 101 of 2018, corresponding to G. R. No. 329 of 2020 whereby and wherein the learned A.C.J.M., Ghatshila was pleased to cancel the provisional bail granted to the petitioner in connection with the aforesaid case. It was submitted that the petitioner was on provisional bail for two years and on the direction of the court, the petitioner has returned the Stree Dhan to his wife but his bail was cancelled on the ground that he has not returned the Stree Dhan and also without hearing him. The provisional bail of the petitioner was cancelled on 03.09.2022. However, the petitioner has filed this application on 21.02.2023. On query, Mr. Rajeeva Sharma, learned Senior Counsel appearing on behalf of the petitioner submitted that the case is pending for the appearance of the petitioner. Considering the entire gamut of this case, no case for quashing of order dated 03.09.2022 is made out. However, the petitioner shall appear before the learned court below within two weeks from the date of receipt of copy of this order and file fresh application for grant of bail and the petitioner shall take all the grounds which have been taken in this application, before the learned A.C.J.M., Ghatshila and learned A.C.J.M., Ghatshila, shall dispose of the bail application on its merit and on the basis of the submissions made by the parties and also considering the submission that he has already returned the Stree Dhan to his wife.
