Order on Board 08.05.2025 1) The petitioner has filed this petition seeking the following relief(s):-
“(i) That, this Hon'ble Court may kindly be pleased to call for the entire record pertaining to the petitioner's case, in the interest of justice. (ii) That, this Hon'ble Court may kindly be pleased to command and direct the respondent authorities to extend the benefit of grant of regular pay scale from 01.02.2005 and increments and pay the arrears of regular pay scale to the petitioner. (iii) That, this Hon'ble Court may kindly be pleased to command and direct the respondent authorities to allot the GPF account number to the petitioner for necessary deduction under the scheme of General Provident Fund, to get the retiral benefit and pension after retirement. (iv) Any other relief which may be suitable in the
facts and circumstances of the case, may also be granted.” 2) Mr. Dembra, learned counsel for the petitioner would submit that initially the petitioner was appointed to the post of Time Keeper in the year 1984. He would submit that the petitioner was appointed as contingency paid employee on
01.01.1990. He would contend that the services of the petitioner were regularized on 29.01.2005 and he got retired from the services in the year 2018. He would further submit that a direction may be issued to the respondent authorities to reckon the services of the petitioner from 1990 to 2005 for the purposes of pension and other benefits. He would also contend that a representation was made by the petitioner
-3- before the respondent authorities on 05.06.2014, but till date same has not been considered and decided; thus, he would pray that a direction may be issued to the respondent authorities to decide the pending representation of the petitioner in objective manner strictly in accordance with law. 3) On the other hand, Mr. Pandey, learned would oppose the submission made by Mr. Dembra and submit that the petitioner was appointed in the year 1984 as a daily rated employee, his services were regularized in the year 2005, therefore, that period cannot be reckoned for the purposes of calculation of pension. He would pray that the instant writ petition deserves to be dismissed. 4) Mr. Shadangi, learned Panel Laywer would support the submission made by Mr. Pandey. 5) Heard. 6) Taking into consideration the limited prayer made by Mr. Dembra, at this stage, this writ petition is disposed of directing respondents No.4 & 5 to decide the pending representation of the petitioner dated 05.06.2014 in objective manner strictly in accordance with law preferably within a period of 120 days from the date of receipt of copy of this order. 7) With the aforesaid observation(s) and direction (s), this writ petition is hereby
