2025:UHC:4220 SL. No. Date Office Notes, reports, orders or proceedings or directions and Registrar’s order with Signatures COURT’S OR JUDGE’S ORDERS ABA/524/2025 Hon'ble Rakesh Thapliyal, J. 1. Mr. Vaibhav Singh Chauhan, learned counsel for the applicants. 2. Mr. Pradeep Lohni, learned Brief Holder for the State. 3. Present applicant is praying for anticipatory bail in relation to FIR dated 12.03.2025 registered as FIR No. 77 of 2025 at P.S. Raipur District Dehradun wherein the present applicant has been implicated for the offence punishable under Section 420 IPC. 4. It is contended by the learned counsel for the applicant that offence, as alleged, is punishable for less than seven years and the investigating agency is following the procedure as prescribed under Section 35(3) of BNSs 2023, however, under the garb of said notice the applicant is being harassed by the I.O. 5. The said apprehension is baseless since learned Brief Holder apprise to this Court that applicant is not being harassed since the investigating agency followed the procedure as prescribed under Section 35(3) of BNSS. 6. Be that as it may, the task of the investigating agency is only to complete the investigation and if the applicant is cooperating with the investigation, the investigation should come to a logical conclusion but unnecessary harassment is wholly unwarranted. 7. In view of the above, the instant anticipatory bail application is finally disposed of with a direction to the I.O. to proceed with the investigation in accordance with law without causing 2025:UHC:4220 unnecessary harassment to the applicant. It is made clear that the applicant shall cooperate with the investigation as and when requires. (Rakesh Thapliyal, J.) 20.05.2025 Parul
