CORAM: HON'BLE MR. JUSTICE MOHAMMAD NAWAZ ORAL ORDER This petition is preferred by the de-facto complainant in Crime No.20 of 2023 registered at HSR Layout Police Station, Bengaluru City. 2. The crime is registered against petitioner’s husband and his alleged second wife, for the offence punishable under Sections 494, 506, 498-A, 504, 323 r/w. 34 of IPC. On completion of investigation, police have filed the charge sheet and the case is now pending before the

XXXIX Additional Chief Judicial Magistrate, Bengaluru in CC No.3297/2024. 3. The present petition is filed seeking permission to withdraw the criminal case pending before the trial court on the ground that the de-facto complainant has settled the matter with the respondents 2 and 3/accused Nos.1 and 2. 4. The matter arises out of a matrimonial dispute. Since the de-facto complainant herself has preferred this petition, seeking to withdraw the case registered against respondents 2 and 3, the facts need not be gone in detail. 5. It is submitted by the learned counsel for the petitioner that O.S.No.7980/2022 was filed by the petitioner along with her children, against her husband i.e., respondent No. 2 herein, for partition and declaration. In the said suit a joint compromise petition was filed, consequent to which the Civil Court has recorded a compromise decree. - 4 -

It is relevant to refer to para 14 of the compromise petition filed before the Civil Court. “The parties have agreed that the plaintiff No.1 shall withdraw all the legal proceedings initiated by her against the defendant No. 1, including Criminal Misc. No.177/ 2024 pending in the Court of Judicial Magistrate First Class (Traffic Court – VI), Bengaluru and CC No.3297/2024 pending in the Court of XXXIX Additional Chief Judicial Magistrate, Bengaluru City and the same is condition precedent of this compromise petition.”
7. In light of the above, no purpose will be served in continuing the criminal proceedings initiated against respondent Nos. 2 and 3. In order to ensure justice is served, it is expedient to close the proceedings pending before the trial court. Hence, the following order:
(i) The petition is allowed.
(ii) The petitioner is permitted to withdraw the case in C.C.No.3297/2024 pending on the file of the Court of XXXIX Additional Chief Judicial Magistrate, Bengaluru and
