M K TIRUPAMA DEVI The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the inaction of the Respondents No 2 and 3 in not taking any action and registering an FIR on the complaints made by the Writ Petitioner as illegal, arbitrary, contrary to the provisions of law and principles of natural justice and equity and consequently direct the Respondents No 2 and 3 to register the Criminal case by registering an FIR against Respondents No 5 to 7 and investigate the case to its logical end and take stringent action against all the persons involved in this fraud.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, as the matter between the parties is of civil nature, the Respondent – Police never interfere with the civil issues unless there are any specific direction from the Court. For ready reference, the written instructions are extracted hereunder: “It is submitted that the factual aspects of the case is that the petitioner sent a representation against the 4th respondent to the 2nd respondent i.e., Superintendent of Police, SP Office, Eluru, West Godavari District on dt:22-12-2017, and the same was endorsed to the 3rd respondent i.e., Station House Officer, Eluru II Town Police Station, West Godavari District. Basing on the contents of the petitioner's representation the 3rd respondent called the petitioner for preliminary enquiry. Further the petitioner appeared before the 3rd respondent police. further enquired about the petitioner's representation after due enquiry it is came to light that, earlier the petitioner filed a writ petition before the Hon'ble High Court vide W.P.No.4045 of 2017 against the 4th respondent in the above writ petition and the said case was disposed on dt:13-08-2024. As the matter is purely related to the civil issues the Respondent police never interfere with the civil issues unless there are any specific direction from the Hon'ble Court.” 3 3. Sri B.S.N.Naidu, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out her remedies before appropriate forum in accordance with law. There shall be no order as to costs.
