IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 2204 of 2025 ------- Mohan Nayak, aged about 25 years old, son of Singo Nayak, resident of village Itihasa, P.O. Unchibita, P.S. Toklo, District West Singhbhum, Jharkhand. …... …. Petitioner(s) Versus The State of Jharkhand .…. …. Opp. Party -------- CORAM : HON’BLE MR. JUSTICE AMBUJ NATH -------- For the Petitioner(s) : Mr. Madhav Prasad, Advocate For the State : Mr. Satish Kumar Keshri, A.P. P. -------- 02/ Dated 20.03.2025 Heard the parties. The petitioner has been made accused in connection with Seraikella P.S. Case No. 29 of 2024, corresponding to G.R. Case No.370 of 2024, for the offence under Sections 302/201/34 of the Indian Penal Code, pending in the court of learned Principal District & Sessions Judge, Seraikella. On 07.03.2024, dead body of the son of the informant was found near Tidildih Check Dam. The deceased was stoned to death. It was submitted that petitioner is not named in the F.I.R and nothing was recovered on his confession. It was further submitted that similarly situated co-accused Shiv Shankar Nayak has been granted bail by this Court earlier in B.A. No. 10385/2024. Learned A.P.P on behalf of the State has opposed the prayer for bail. Considering the fact that apart from confession, there is no material against the petitioner on record, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Principal District & Sessions Judge, Seraikella, in connection with Seraikella P.S. Case No. 29 of 2024, corresponding to G.R. Case No.370 of 2024. (Ambuj Nath, J.) BS/-
