Deka, the learned counsel appearing for the petitioner and Mr. D P Goswami, the learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 482 of the BNSS, 2023 praying for grant of pre-arrest bail in respect of Hatigaon PS Case No. 16/2025. 3. The owner of gym lodged an FIR before police alleging that his employee Smt. Ruhi Sunar has misappropriated a huge amount of amount belonging to the gym owner. Page No.# 2/2 4. Already this Court had allowed Smt. Ruhi Sunar to go on bail. The present petitioner is the boyfriend of Smt. Ruhi Sunar. There is nothing in the record to show that the present petitioner was in any way involved with the act of Ruhi Sunar. 5. I have considered the submissions made by the learned counsel of both sides. 6. This Court is of the opinion that the petitioner does not deserve to be detained in custody. Therefore, his prayer of pre-arrest bail is allowed. 7. It is hereby directed that in the event of arrest in connection with Hatigaon PS Case No. 16/2025, the petitioner Nikuraj Handique shall be released on bail of ₹20,000/- with a surety of like amount to the satisfaction of the arresting authority. 8. The petitioner shall co-operate with the Investigating Officer as and when called for. With the aforesaid direction, the bail application stands disposed of. The CD shall be returned.
