JUSTICE JAYANT BANERJI) Today, a joint application under Section 13B of the Hindu Marriage Act, 19551 has been filed by the parties, who are present before the Court and are identified by their respective advocates, seeking a decree of divorce dissolving the marriage solemnized between the appellant and the respondent on 07.05.2018 at Rajendra Kalyana Mantapa, Mysore. 2. The aforesaid application is accompanied by a joint affidavit signed by the parties, affirming the averments made in the application filed under Section 13B of the HM Act. 3. A Memorandum of Compromise Petition under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure is already on record. The terms of the compromise have been set out in detail in the aforesaid Memorandum, which has been duly signed by the parties as well as their respective counsel. The parties have requested the Court for allowing the application filed under Section 13B of the HM Act, in terms of the compromise appearing in the Memorandum of Settlement dated 28.10.2025. 5. In the facts and circumstances of the case, the judgment and order dated 09.10.2023 and the decree dated 13.10.2023 made by the II Additional Principal Family Court, Mysore in M.C.No.371/2021, are set aside. 6. Having considered the records and the application filed under Section 13B of the HM Act, the said application dated 30.10.2025 is hereby allowed. 7. The marriage between the appellant and the respondent which was solemnized on 07.05.2018 at Rajendra Kalyana Mantapa, Mysore, is hereby dissolved. - 4 - HC-KAR NC: 2025:KHC:43366-DB MFA No. 7843 of 2023 8. A decree of divorce is directed to be issued. The terms of the compromise appearing in the Memorandum of Compromise dated 28.10.2025 shall form part of the decree.
