ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU,CHIEF JUSTICE)
1. Issue notice. 2. Learned Additional Government Advocate accepts notice for respondent No.2. 3. The complainant has filed the present complaint alleging that the accused has not complied with the order dated 07.06.2024 inasmuch as the accused has paid the interest due after a delay of more than a year. 4. The operative part of the said order reads as under:
"(i) Writ petition is allowed in part.
(ii) The petitioner is held entitled to interest at bank rates prevailing in respective years from time to time from the date of initial deposit till the date it was returned to the petitioner. (iii) The claim for compound interest stand rejected. (iv) In the light of the observations made in the course of the order, the petitioner is reserved liberty to agitate his claim for compensation before any appropriate fora. (v) All contentions qua compensation of both parties shall remain open."
5. It is clear from the above that the petitioner is entitled to interest at bank rates prevailing in respective years from time to time from the date on which initial deposit was made till the date it

was returned. Admittedly, the interest on the principal amount has been paid, albeit, on 03.07.2025. According to the complainant, there has been an inordinate delay of one year in paying the interest and therefore, the accused would be also liable to pay further interest. 6. The order in question does not contemplate payment of interest on interest. The operative part is confined to directing payment of interest till the principal was paid. Although there has been some delay in complying with the order dated 07.06.2024, indisputably, the said order has been complied. 7. No order to pay further interest can be passed in these proceedings. We do not consider it apposite to initiate any action for willful disobedience of the aforesaid order. 8.
