The Court made the following ORAL ORDER:
Heard Sri P. Nagendra Reddy, Learned Counsel for the Writ Petitioner and Sri Arjun Chowdary, Learned Asst. Government Pleader for Revenue. 2. It is the contention of the Writ Petitioner that the Official Respondent No.1 has undertaken an enquiry without any jurisdiction. The facts in the present case would indicate that, the mother of the Respondent No.4 is the sibling sister of the Writ Petitioner. The property originally stood in the name of the mother of the Unofficial Respondent No.4. After her demise, the property appears to have been mutated in the name of the Writ Petitioner, who is the maternal uncle of the Unofficial Respondent No.4. The Unofficial Respondent No.4 has submitted a Complaint in the ‘Revenue Sadassulu’. In pursuance of the said Complaint, the Tahsildar has issued the present impugned Notice dated 29.01.2025 (Ex.P.1). On the face of it, the facts in this case would indicate that the property belonging to the mother of the Writ Petitioner has been mutated in the name of his maternal uncle, who is the Writ Petitioner herein. 3. In this view of the matter, this Court is of the view that the Official Respondent is within his powers in issuing the Notice to the Writ Petitioner for conduct of an enquiry in order to ascertain the entitlement of the Writ Petitioner over the subject land or otherwise. In this view of the matter, this Court is of the opinion that, the attempt to challenge the Notice issued by the Tahsildar (Respondent No.1) is devoid of merit. 4. Accordingly, this Writ Petition is dismissed. No order as to costs. 5.
