It was submitted, accused no.2 being authorized signatory of accused no.1 had issued a cheque bearing no.004964 dated 24.09.2019 for Rs.50 Lakhs drawn on Andhra Bank, Bannerghatta Branch, Bengaluru, in favour of complainant, which when presented for collection, returned with endorsement 'payment stopped by drawer' on 20.11.2019 and even after demand notice dated 27.11.2019 was served on accused, they failed to repay amount within time, thereby committed offence punishable under Section 138 of NI Act. 5. & Anr., reported in (2012) 9 SCC 460, has held scope for interference against concurrent findings would be normally confined to examining whether findings suffer from perversity or are contrary to statutory provisions of law. 9. While passing impugned judgment, trial Court took note of in support of his case, PW.1 had produced Board Resolution, original cheque, Bank Endorsement, Demand Notice along with postal acknowledgment as well as certified copy of Loan Agreement as Exs.P1 to P9. Admittedly, accused did not even participate in proceedings, failed to cross-examine PW.1, appear for recording of his statement under Section 313 of CrPC as well as failed to lead rebuttal evidence. Existence of transactional relationship of creditor and debtor between parties was established not only by oral testimony but also by Ex.P9 - Loan Agreement. Issuance of cheque is towards repayment of said loan acknowledged in Ex.P9. There is no dispute about presentation of cheque, its dishonour, issuance of demand notice and failure of accused to repay amount. Thus, necessary foundational facts for recording finding for conviction were noted by trial Court. Though inability of accused to avail opportunity is pleaded, nothing prevented accused from

availing said opportunity in appeal. Appellate Court, on independent re-appreciation, confirmed judgment passed by trial Court.
Though several grounds are urged in this revision petition, there is no material to substantiate same. Thus, impugned judgments are not established to be suffering from perversity or contrary to statutory provisions so as to invite interference. 10. Consequently, no useful purpose would be served in condoning delay. I.A.no.1/2025 is rejected and consequently, revision petition is dismissed. In view of dismissal, I.A.no.2/2025 does not survive for
consideration and same stands dismissed.
