ORAL ORDER The present petition has been filed seeking to quash the proceedings filed in Crime No.1/2017 registered by the New Market Police Station for the offences punishable under Sections 341, 323, 506 r/w. 34 of IPC and Section 4 of the Karnataka Prohibition of Violence against Medicare Service Personnel and damage to property in Medicare Service Institutions Act, 2009.
2. It is noticed that an interim order has been granted staying the proceedings against the petitioner on
20.09.2017. The matter has been posted on various dates and the interim order has been extended from time to time. On 29.08.2024, this Court had passed an order that reads as hereunder:
“There is no representation for the petitioner.

As a last chance, list this matter on
19.09.2024. Interim order granted earlier, is extended till the next date of hearing.”
3. Subsequently, interim order was extended on various dates. On 06.03.2025, this Court had passed an
order directing the petitioner to serve copy of the petition. On 20.03.2025, there was no representation on behalf of the petitioner. The order passed reads as hereunder:
“There is no representation on behalf of the petitioner. Learned Additional S.P.P. for respondent- State is present. This Court, on the previous date of hearing, has directed the petitioner to serve a copy of the petition along with the documents. The same has not been served. Hence, call this matter on 07.04.2025 with a direction to the learned counsel for petitioner to furnish one set of petition along with documents to the learned Additional S.P.P. for respondent – State.

Interim order, if any, granted earlier is extended till the next date of hearing.”
4. On 07.04.2025, there was no representation on beryl of the petitioner when the matter was called. The
order reads as hereunder:
“There is no representation on behalf of the petitioner. Learned Additional S.P.P. for respondent- State is present. Despite direction to serve a copy of the petition on the learned Additional S.P.P. for respondent-State, copy is not served. Call this matter on 21.04.2025. In the meanwhile, copies to be served on the learned Additional S.P.P. for respondent-State.”
5. Learned Additional S.P.P. for respondent-State is present.
6. The Court had noticed that, despite direction to serve copy of the petition, copy was not served. On 30.07.2025, once again, there was no representation on

behalf of the petitioner. When the matter is called out once again there is no representation on behalf of the petitioner. The petitioner is not diligent in prosecuting the matter. Several opportunities has been granted. Taking note of the absence of the petitioner in prosecuting the petition as evidenced from the order sheet, the petition is dismissed for non-prosecution.
