This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Misc. Application No. 719 of 2024 under Section 446 Cr.P.C. dated 20.10.2023 filed by the applicant in Sessions Trial No. 994 of 2016 under Sections 328, 376, 323, 504, 506, 500 I.P.C., Police Station- Kotwali Nagar, District- Ghaziabad pending in the Court of learned District and Sessions Judge, Ghaziabad expeditiously within stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the opposite party nos. 2, 3 and 4 are the accused persons who are bailed out in the aforesaid matter but the property which was submitted as surety before the Court concerned has been sold out by them without informing and taking permission of the Court conerned for the same. In this regard a Misc. Application No. 719 of 2024 was filed by the present applicant but no order has been passed by the trial Court on the said application which is pending for disposal. 4. Learned AGA opposed the prayer. 5. I have considered the submissions and perused the record. 6. In the circumstances, the Court concerned is directed to make all endeavours to decide the aforesaid application expeditiously preferably within a period of three months from the date of production of certified copy of this order before it, keeping in view the heavy work load in the said Court. 7. It is also made clear that the Court / Presiding Officer is not the only stake holder in the trial and disposal of a case, hence, besides the P.O. concerned, all the stake holders i.e. police and executive authorities, counsels, parties to the case, staff etc. are also made bound by this order and it will be their responsibility also to assist the Court in every manner for the expeditious disposal of this case. 8.
