Barbhuiya, the learned counsel appearing for the petitioner and Mr. K. Baishya, the learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 482 of the BNSS, 2023 praying for grant of pre-arrest bail in respect of Basistha PS Case No. 34/2025. Page No.# 2/2 3. The petitioner took a vehicle from the informant on rent. The informant runs a rental car business. The petitioner hired a vehicle from the informant to visit Nagaland. He was to pay ₹20,000/- for using the car for 10 days. After 10 days the informant came to know that his vehicle was parked at a place in Dimapur, Nagaland for more than 50 hours. Apprehending foul play on the part of the informant, the petitioner sent him to Dimapur to recover the car. Ultimately the car was recovered from Dimapur and it was given to the custody to its original owner. 4. The learned counsel for the petitioner has submitted that the petitioner has already paid ₹30,000/- to the informant and he was to pay more money for keeping the vehicle in his custody for more than the stipulated period of time. Apart from that, there are no incriminating materials against the present petitioner. 5. I have considered the submissions made by the learned counsel of both sides. 6. This Court is of the opinion that under the given circumstances of the case the petitioner does not deserve to be detained in custody. Therefore, his bail application is allowed. 7. It is hereby directed that in the event of arrest in connection with Basistha PS Case No. 34/2025, the petitioner Kaushik Choudhury shall be released on bail of ₹20,000/- with a surety of like amount to the satisfaction of the arresting authority. 8. The petitioner shall co-operate with the Investigating Officer as and when called for. With the aforesaid direction, the bail application stands disposed of. The CD shall be returned.
