order dated 27.03.2024
made in Crl.A.No.422/2024 whereby the first Appellate Court passed an interim order of stay in favour of Petitioner subject to the Petitioner depositing monthly maintenance in a sum of Rs.15,000/- per month from the date of filing of Crl.Misc. No.53/2023 until further orders.
2. Heard the learned counsel for the Petitioner,
learned counsel appearing for the Respondent and perused the material on record.
3. A perusal of the material on record will indicate that in the first instance, in the Crl.Misc.No.53/2023 filed by the Respondent - wife against the Petitioner -husband under Sections 12 of the Protection of Women from

HC-KAR NC: 2025:KHC:25596 WP No. 13911 of 2024 Domestic Violence Act, 2005, the trial court passed an
order of interim maintenance directing the Petitioner to pay Rs.20,000/- per month to the Respondent - wife. Aggrieved by the said order of interim maintenance passed by the trial Court, Petitioner approached the first Appellate Court in Crl.A.No.422/2024 in which the first Appellate Court stayed the trial Court's order subject to the Petitioner paying a monthly maintenance of Rs.15,000/- per month to the Respondent -wife from the date of filing the aforesaid Crl.Misc.No.53/2024 until further orders. Aggreived by the said order passed by the first Appellate Court, the Petitioners is before this Court by way of present petition.

It is a matter of record and an undisputed fact that during the pendency of the present Petition, the petitioner has paid certain amounts in favour of the Respondent-wife before the trial Court which is recorded before the trial Court. It is also not in dispute that the appeal is posted before the first Appellate Court on

31.07.2025. Under these circumstances, though several
contentions have been urged by both the sides in support of the respective claims, without expressing any opinion on the merit/demerits of the rival contentions, I deem it just and appropriate to dispose off this petition by directing the first Appellate Court to dispose off the main Appeal within a stipulate time frame by issuing certain directions in this regard. Accordingly, I pass the following:
ORDER 1) Petition is hereby disposed off. 2) The first Appellate Court before whom Crl. Appeal No.422/2024 is pending is directed to dispose off the Appeal within a period of two months from 31.07.2025. 3) The Petitioner is directed to pay a sum of Rs.20,000/- before the trial Court on 31.07.2025 which would be adjusted by the first Appellate Court at the time of final disposal of the Appeal.
