The following prayer has been made in the writ petition: (i) issue a writ, order or direction in the nature of mandamus commanding the Respondent Nos. 2 and 3 to consider the claim of the petitioner in pursuance with the bid/tender GEM/2024/B/5603698 issued by respondent No. 3, (Basic Shiksha Adhikari, Bijnor)." 2. The petitioners submitted a bid for Manpower Outsourcing Services - Fixed Remuneration - Admin; ECCE Educator; Graduate. The bid of the petitioners was cancelled. The cancellation of the bid has not been challenged. It is admitted that fresh bids were invited and in which the petitioners also submitted their bid. 3. Learned counsel appearing on behalf of respondent no. 3 submits that since the cancellation of the bid is not under challenge, therefore, the prayer cannot be granted. 4. We find sufficient force in the submission. Moreover, as admitted, the petitioners have already submitted bid in pursuance of fresh advertisement and for the said reason as well, we decline to grant the relief, prayed for. 5. Accordingly, the writ petition is dismissed but without prejudice to the bid, which has been submitted by the petitioners in pursuance of fresh advertisement. (R.M.N. Mishra, J.)
