Abdullah, learned counsel appearing for the applicant and Ms. N Das, learned Additional Public Prosecutor for the State of Assam. 2) This application has been filed under Section 430 BNSS, 2023 praying for suspension of Page No.# 2/2 sentence imposed upon the applicant Md. Abdul Ikram. 3) The learned Additional Sessions Judge (FTC), Lakhimpur, North Lakhimpur had convicted Md. Abdul Ikram under Sections 304(B) and 498(A) of the IPC in Sessions Case No. 06(NL)/2022. 4) Ms. Das, learned APP has objected to this application on the ground that the learned Trial Court has rightly convicted the applicant. 5) I have considered the submissions made by the learned counsels of both the sides. 6) I have also gone through the impugned judgment. 7) The prayer made by the applicant is allowed. 8) The sentences imposed upon the applicant Md. Abdul Ikram by the learned Additional Sessions Judge (FTC), Lakhimpur, North Lakhimpur in Sessions Case No. 06(NL)/2022 shall remain suspended till disposal of the connected appeal. 9) The applicant Md. Abdul Ikram shall be released on bail of Rs. 25,000/- with a surety of the like amount, to the satisfaction of the learned Additional Sessions Judge (FTC), Lakhimpur, North Lakhimpur. 10) With the aforesaid direction, this interlocutory application stands disposed of.
