The present application u/s 528 of BNSS of 2023 has been filed with prayer to quash the order dated 12.11.2024 passed by Additional Principal Judge, Family Court, Agra in Criminal Misc. Case No. 2864 of 2024 (Smt. Tasleem vs. Imran), arising out of an application under Section 144(3) BNSS [125 (3) of Cr.P.C.] passed passed by Additional Principal Judge, Family Court, Agra. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicant after retaining a photocopy of the same. However, applicant will move an application before the court concerned for adjustment of the amount, which has been paid by the applicant and pay arrears of maintenance in installments.
